Terms of Use
For the purposes of this document, the term "UNSW" refers to the University of New South Wales, the term "BSOC" refers to the University of New South Wales Business Society and the term "user" refers to persons access accessing the BSOC website, unless an intention to the contrary is explicitly stated.

The user’s access to the website is conditional upon his/her acceptance and compliance with the terms, conditions, notices and disclaimers contained in this document and any other notices displayed elsewhere on this website – all of which are hereby incorporated by reference into the "Terms of Use". The user’s use of, and/or access to, the website constitutes his/her agreement to the Terms of Use. Failure to comply with the Terms of Use may result in the termination of the user's account. BSOC reserves the right to terminate a user’s account and/or ban a specific user at any time without notice. BSOC reserves the right to modify or update the Terms of Use at any time without notice, and thus the user should regularly revisit this page to review the then current Terms of Use by which they are bound.

Disclaimer of Liability

BSOC aims to ensure the accuracy of the information provided at or through this website. However, given the changing nature of laws, rules and regulations, and the inherent hazards of electronic communication, there may be delays, omissions or inaccuracies in information contained at this website. Further, BSOC may make changes to the materials at this website at any time without notice. Accordingly, the user should not act on the basis of any information accessed at or through this website without obtaining and considering appropriate advice from UNSW authorities or appropriate professional advice, upon the user’s own circumstances.

To the maximum extent permitted under the law, in no event will BSOC and its employees be liable for any damages whatsoever (including, without limitation, direct, indirect, punitive, special, consequential damages, lost profits, lost data or business interruption) arising out of the use, inability to use, or the results of use of this website, any web websites linked to this website, or the materials or information contained at any or all such websites, whether based on contract, tort, statute, common law, equity or any other legal theory and whether or not advised of the possibility of such damages. If circumstance arise where the user is entitled to claim damages from BSOC notwithstanding the provisions of these Terms of Use, BSOC’s liability to the user for the aggregate of such claims (regardless of the basis on which the user is entitled to claim from BSOC including, without limitation, negligence) is limited to the provision of the services again or the cost of providing the services again (at BSOC’s election).

There are many inherent risks involved in transmitting information over the Internet. Unauthorised access and faults in computer networks can and do occur which may result in the interception, corruption, alteration, non-delivery, incorrect delivery or loss of information transmitted over the internet. Consequently, BSOC is unable to warrant that this website will be free from such risks. Further, BSOC cannot and does not guarantee or warrant that any files available for downloading through this website will be free of infection or viruses, worms, Trojan horses or other code that manifests contaminating or destructive properties. The user is responsible for implementing sufficient procedures and checkpoints to satisfy his/her particular requirements for accuracy of data input and output, and for maintaining an appropriate means for the reconstruction of any lost data.

Intellectual Property and Copyright

BSOC owns and retains the copyrights in this website. The user may download, view and print materials from this website subject to the following: (i) the materials must be used solely for personal, informational, non-commercial purposes; and (ii) the materials must not be modified or altered in any way. Except as expressly provided herein, the user must not use, download, upload, copy, print, display, perform, reproduce, publish, license, post, transmit or distribute any materials from this website in whole or in part without the prior written permission of BSOC. If the user breaches any of these terms, the user’s authorisation to use this website automatically terminates and the user must immediately destroy any downloaded or printed materials.

Forum/Message Board Content

Considering the real-time nature of the forums/message boards, it is impossible for BSOC to review all messages or confirm the validity of information posted. BSOC does not vouch for or warrant the accuracy, completeness or usefulness of any message posted by any of its users, and is not responsible for the content of any message. The messages solely express the view of the author of the message, not the views of BSOC or any entity associated with BSOC.

User Registration

When and if the user registers to become a member on the website, they agree to (i) provide true, accurate, current and complete information about themselves as prompted by the registration form and (ii) to maintain and update their information to keep it true, accurate, current, and complete. If any information provided by the user is untrue, inaccurate, not current, or incomplete, BSOC reserves the right to terminate the user’s registration and account at any time without notice. BSOC may refuse to grant the user usernames that it considers illegal, vulgar or inappropriate, at its discretion. The user will be responsible for the confidentiality and use of their username and password and agree not to transfer or resell their use of or access to the Website to any third party.

User Submissions

By electronically transferring or otherwise providing or making available to BSOC any notes, papers, or other resources, or any other materials at all, the user declares that the material s/he provides is either his/her own original work or is work for which he/she has permission to publicly distribute. S/he acknowledges that s/he is responsible for the materials that s/he submits, and that s/he, not BSOC, has full responsibility for the materials including their legality, reliability, appropriateness, originality and copyright. S/he declares that s/he is giving permission to BSOC to redistribute and reproduce the submitted materials in any form and in any way, without limitation. S/he acknowledges that this permission is granted as a necessary condition of submission and that BSOC cannot be held liable for copyright infringements or any other legal issues which may arise from the submission. S/he also agrees to release BSOC from being held responsible for any negative consequences that may arise from submission of materials including, but not limited to, any legal ramifications or any losses.

User Behaviour

BSOC will not tolerate users expressing forms of bigotry, racism or hatred, or user behaviour in the form of threats, harassment, stalking, or abuse. The user must verify with moderators and/or administrators of the forum if they are in any doubt as to whether the content they wish to post is appropriate. Topics of discussion that are considered inappropriate in the forum can be deleted at the discretion of the moderators and/or administrators, at any time without notification. BSOC does not allow any illegal activities on its forum. The user cannot use the forum to publish, post, distribute, or disseminate defamatory, infringing, obscene, or other unlawful material or information. BSOC will not condone users seen to be using the forum signature as an advertising mechanism and/or emailing or private messaging other users with spam regarding their services. The BSOC moderating/administrative team reserve the right to give a final warning to users violating this clause and after consideration terminate the users’ account and/or ban the users.

Sale Advertisements

Any use of the BSOC Textbook Corner for private purposes is solely at the user’s own risk and BSOC has no liability for such use. It is the user’s responsibility to advise the moderating team when an item has been sold. BSOC reserves the right to delete advertisement posts which it considers inappropriate, at its discretion at any time and without notice. The user must be legally able to sell or can legally facilitate the purchase/rent transaction of the entity or entities they list on the Textbook Corner. The information provided by the user must not: be false, inaccurate or misleading; be fraudulent or involve the sale of counterfeit or stolen items; infringe any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy; violate any applicable law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, criminal law, antidiscrimination or trade practices/fair trading laws); or be defamatory, trade libellous, unlawfully threatening or unlawfully harassing.

Links to third party web websites on this Website are provided solely as a convenience to the user and such links should not be taken to imply any type of association, sponsorship, endorsement, monitoring, approval of, or responsibility for, the linked website or its content. BSOC has not reviewed any of these third party websites and should the user decide to access any of the third party websites linked to this website, they do this entirely at their own risk. Any website that links to this Website must not replicate BSOC content, must not imply any endorsement by BSOC (unless given express permission), and must not use the BSOC logo without the prior written permission of BSOC.

Legal Ramifications

These Terms of Use shall be governed by and construed in accordance with the laws of New South Wales, Australia, without giving effect to any principles of conflicts of law. Any legal proceedings arising out of or in connection with the use of this website must be commenced in the appropriate court in New South Wales. If the user accesses this website from locations outside of New South Wales, the user is solely responsible for compliance with their local laws. If any provision of these Terms of Use is unlawful, void or for any reason unenforceable, then that provision shall be deemed severed from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
